These Terms of Use ("Terms") govern your use of riverislandcondos.com (the "Site"), operated by New Condos & Homes — Insider Condos Inc ("we," "us," "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Marketing Materials Only — Not an Offer

All content on this Site — including renderings, floor plans, prices, ROI projections, amenities lists, completion dates, unit counts, and availability — is marketing material only. Nothing on this Site constitutes an offer to sell or a solicitation to buy real estate. Final terms are defined exclusively in the official Purchase & Sale Agreement provided by the developer, Noval Properties, and only an executed contract creates legal obligations.

2. Pre-Construction Risk Disclosure

River Island Condos at Atlántida is a pre-construction development. Pre-construction real estate carries risks that fully-built real estate does not, including but not limited to:

Delivery delays — construction timelines often slip due to weather, permits, supply chains, or developer financing
Specification changes — final finishes, amenities, layouts, and unit counts may differ from renderings and marketing materials
Price changes — published prices may change without notice prior to contract signing
Cancellation — in rare circumstances, the developer may cancel the project entirely, in which case deposits are typically returned per the Purchase & Sale Agreement
Market risk — Caribbean real estate values may decline; rental income is not guaranteed
Currency risk — USD prices may not reflect equivalent values in your home currency
Regulatory risk — Dominican Republic property laws, foreign-buyer rules, and tax treatments may change

You should consult independent legal, financial, and tax professionals before any pre-construction purchase.

3. ROI & Rental Income Projections

Any return-on-investment, rental yield, or cash flow figures displayed on this Site (including in the on-page calculator) are projections based on developer estimates and comparable Caribbean managed-rental programs. They are not guarantees.

Actual rental income depends on occupancy rates, average daily rate, seasonality, hurricane disruptions, competition from other properties, and overall tourism demand
Past performance of comparable properties does not predict future results for River Island
Management fees, HOA dues, property taxes, insurance, repairs, utilities during vacancy, and currency conversion all reduce net returns
CONFOTUR tax exemptions are subject to Dominican Republic legislation and may change

You may use this Site for personal, non-commercial purposes to learn about River Island Condos and submit inquiries. You may NOT:

Scrape, copy, or republish Site content for commercial use without our written permission
Use automated tools (bots, crawlers) to submit forms or extract data
Attempt to access non-public areas of the Site or its underlying systems
Submit false, misleading, or fraudulent contact information
Use the Site to send spam, harvest emails, or harass our team or other users

The Site may link to or embed third-party services (Google Drive, Calendly, Follow Up Boss, etc). We are not responsible for the content, privacy practices, or terms of those services. Use at your own discretion.

9. Limitation of Liability

To the maximum extent permitted by law, New Condos & Homes — Insider Condos Inc, its officers, employees, agents, and affiliates shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of this Site or reliance on its content, even if advised of the possibility of such damages.

The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify and hold harmless New Condos & Homes — Insider Condos Inc and Noval Properties from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any third-party rights.

11. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be brought exclusively in the courts of Ontario, and you consent to personal jurisdiction there.

If you are accessing the Site from outside Canada, you do so on your own initiative and are responsible for compliance with local laws.

12. Changes to These Terms

We may revise these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated via a prominent site notice. Continued use of the Site after revisions constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
